Thank you for your question. You can only apply for a student visa after you have been accepted into a college or university in the U.S. and receive notification (I-20 or DS-2019) of your acceptance into that university or college.

Restrictions on Attending Public Elementary and Secondary Schools
Congress passed a law in 1996 that placed restrictions on foreign students in U.S. public elementary (kindergarten through eighth grades) and secondary (grades nine through twelve) schools. Secondary school is also called high school. The restrictions are given below:
prohibits foreign students from attending public elementary schools or publicly-funded adult education programs
limits secondary school attendance to twelve months
requires secondary school students to pay the school the full, unsubsidized per capita cost (cost for each student) of education
Go to Section 625 of Public Law 104-208 for the text of the new law.
Restrictions Are for F-1 Students Only
The restrictions apply to these foreign students:
foreign students in F-1 status who need an I-20 to study in the United States;
foreign students in F-1 status in public schools who leave the United States and want to return to continue their studies; and
foreign students in F-1 status who want to transfer from a private school or program into a public school or program.
The restrictions do not apply to the following foreign students:
foreign students in another visa status, such as J-2, L-1, M-2, or G-4.
foreign students in F-1 status who attend private schools or private training or language programs
foreign students in F-1 status who were attending public schools when the law came into effect (November 30, 1996)
Students Must Pay the Costs of Public Secondary School Education
Foreign students who want to attend public secondary school (high school) must pay the full, unsubsidized per capita (for each student) cost of education. This amount is listed under the item called "tuition" in the I-20. The full, unsubsidized per capita (for each student) cost of education is the cost of providing education to each student in the school district where the public school is located. Costs normally range between $3000 and $10,000.

Question: I have my F-1 visa valid till jan 2015 but I was delayed to attend the spring semester so I requested to defer my attendance to the fall semester. Will I need another I-20 and will I need to make another interview in the US embassy before I leave for the fall semester.

Check first with the school(International Student Office) that issued the I-20 as they should know if you need to have your I-20 amended. The school should have entered in the SEVIS data base that you did not attend for the Spring semester and that you will attend the next semester. I'm not sure if you will need another visa and interview as you have already been approved.

Question: Hi,
I am a student from Bangladesh studying in a US 4 year college and have a F1 visa for the whole duration. I am studying my 3rd year abroad in the UK, and am thinking of visiting friends in the US for a month during the holiday. I was wondering if I need to apply for a separate visitor visa for this travel, or if my current F1 visa will suffice. I asked someone from my college and they are not sure because I am studying abroad and there might be a problem with my SEVIS status. Please help with any information you can provide.

Answer: Hi,
I have been told that if you have a valid F1 visa and you are in the middle of your studies (3rd yr) that you should be able to enter on your F1 visa. But just in case, you might want to look at the visa waiver program if Bangladesh is on the list or just go on a tourist visa.

Question: Does an undergraduate (Sophomore) student, pursuing a Bachelor's Course in Mechanical Engineering in India, who is issued a I-20 by an American University for pursuing Junior and Senior years of Bachelor's in Mechanical Engineering as an International Transfer Student require SAT Score while attending/applying for the VISA. The student got a TOEFL score of 103/120. Is SAT score a prerequisite for issue of F-1 student visa in this case?
Answer: Hello,
The SAT is not a prerequisite for a visa. It is used by the US university to determine how successful the applying first year student will be at college level work. The US university will have looked at the student's marks from the Indian university in determining whether to admit him or not. The student might need to bring along records from his current Mechanical Engineering course to prove he is a good student. It is always a good idea to document your education and test scores. SAT will not be required as a transfer student, especially one that has already done two years in the home country.
